  • Sometimes referred to as alimony or spousal maintenance, spousal support is the amount of money that is paid to the non-monied spouse (the spouse who was not the primary income earner) after a marriage ends.
  • The purpose of spousal support is to help maintain a lifestyle for that spouse who is comparable to what was enjoyed by him or her throughout the course of the marriage.

A number of factors are considered by the court before a determination on spousal support is made, such as:

  • Length of the marriage
  • Age and health of the spouses
  • Health of the parties
  • Standard of living enjoyed by the parties during the marriage
  • Income earning capacity and potential of each party
  • Any misuse or excessive spending of marital assets
  • If the parties have children together
  • Need to pay for additional expenses for the children
  • Nonfinancial contributions of the paying spouse
  • Spousal support may continue to be required until the recipient spouse is able to support him or herself

Child Support

  • The amount of child support that is to be paid is set by state laws, and the guidelines must be followed in nearly all situations.
  • A formula is used to calculate the amount that is owed. This formula takes things into consideration such as each parent's income, the number of children and any other expenses (such as health care or day care).
