What Is Probate?
Probate is a legal process that begins with a request to open the estate, called a petition. After this is done, a personal representative to the estate is named. This person is responsible for the administration and distribution of the deceased's property. After these steps are taken, an official notice of creditors is printed in a local newspaper and notice of administration is sent to other parties who may have an interest in the estate. Creditors and other parties then have a set amount of time from the date of notification and/or publication of the notice of creditors in which claims against the estate must be filed.
Once all claims have been filed, the named personal representative can pay any estate debts and distribute the remaining assets of the estate. Lastly, a petition for discharge is filed, and the estate is closed.
